COMPLIANCE TO RESPECT COPYRIGHT LAW ON ARCHITECTURAL OBJECTS: STATE, PROBLEMS AND COMPARISON OF THE STANDARDS OF FREEDOM PANORAMA
Abstract
The article analyzes and compares general theoretical legal provisions, as well as the problematic issues: What does the author have the right to photograph - only works incarnations of architecture in the form of architectural objects or in other forms; What can be the purpose of photographing and its character: the personal or property; Who has the right to photograph or videotape the works of architecture - the author personally or at his order, the other persons; the validity of this right; the possibility of the renounce of the use of this right in author's agreement; the possibility of receiving payment by the owner of the work from the author when implementing their right to photograph and videotape in Ukraine and in the world.Key words: copyright, related rights, architectural work, moral rights, property rights, works of architecture, urban planning works, works of gardening art.
